Introduction
This privacy policy (“Privacy Policy”) applies to all visitors and users of the Lexcel website (“Website”), which are offered by LXCL, Inc. and/or any of its affiliates (“Lexcel” or “we” or “us”) and describes Lexcel’s policies and practices regarding its collection and use of your data, and sets forth your privacy rights. Please read this Privacy Policy carefully. By accessing or using any part of the Website, you acknowledge you have been informed of and consent to our practices with regard to your personal information and data.
Applicability of this Privacy Policy
Lexcel’s Services are offered to businesses, companies and/or other entities for professional use (our “Customers”). If you are a Customer of Lexcel, this Privacy Policy does not apply to personal information or other data and information that we process on your behalf (if any) as your service provider (collectively, “Customer Data”). Our use of your Customer Data shall instead be governed by the terms and conditions of the separate customer agreement or terms of service that you have agreed to with us.
If you are using the Services as an employee, contractor or other representative of one of our Customers and you have any questions about our privacy practices or would like to exercise any rights with respect to your personal information that we process on behalf of our customers, please contact the corresponding customer as we only process your personal information in our capacity as a service provider to our customer.
Personal information we collect
Lexcel collects personal information about its website visitors and customers. With a few exceptions, this information is generally limited to:
- name
- job title
- employer name
- work address
- work email
- work phone number
We use this information to provide prospects and customers with services.
We do not sell personal information to anyone and only share it with third parties who are facilitating the delivery of our services.
From time to time, Lexcel receives personal information about individuals from third parties. Typically, information collected from third parties will include further details on your employer, practice or industry. We may also collect your personal data from a third party website (e.g. LinkedIn).
Additionally, like most website operators, Lexcel automatically collects (i) technical information about your device including your device’s internet protocol (IP) address, device type (e.g., phone, tablet), unique identifiers (including identifiers used for advertising purposes), language settings, mobile device carrier, radio/network information (e.g., WiFi, LTE, 4G), and general location information such as city, state or geographic area; and (ii) information about your visit to our Website and online activity data (such as the referral URL, the content viewed and the content interacted with). Some of this information may be collected using cookies, web beacons and related local storage technologies.
We use this data to design our site to meet users’ needs, diagnose server issues, administer the Website, analyze trends, track visitor behavior, and gather demographic information to identify preferences. Lexcel has a legitimate interest in understanding how members, customers, and potential customers use its Website to offer relevant products and services, communicate value to sponsors and corporate members, and provide appropriate staffing to meet needs.
We may aggregate or de-identify Customer Data so that you can no longer be identified and use the aggregated or de-identified data for the following purposes:
- to investigate and study the effectiveness of our services;
- to update and improve our services;
- to market or promote our services;
- to conduct research; and
- to share or publish aggregated information about usage of our services, for example on our blog or on social media (e.g. LinkedIn).
Information Lexcel does not collect
Lexcel does not intentionally collect sensitive or special category personal information, such as genetic data, biometric data for the purposes of uniquely identifying a natural person, health information, or religious information.
Lexcel does not knowingly collect information from or direct our Website or content specifically to children under the age of 18. If we learn or have reason to suspect that a user is under the age of 18, we will close that account.
Sharing your information
Lexcel may share your personal information with the third-parties listed below for the purposes that are described in this Privacy Policy or otherwise with your consent.
Lexcel only shares your personal information with those of its employees, contractors, and affiliated organizations that (i) need to know that personal information in order to process it on Lexcel’s behalf or to provide services available on the Website, and (ii) that have agreed not to disclose it to others.
Lexcel may disclose your personal information to professional advisors, such as lawyers, bankers, auditors and insurers, where necessary in the course of the professional services that they render to us.
Lexcel may sell, transfer or otherwise share some or all of our business or assets, including your personal information, in connection with a business transaction (or potential business transaction) such as a corporate divestiture, merger, consolidation, acquisition, reorganization or sale of assets, or in the event of bankruptcy or dissolution. In such a case, we will make reasonable efforts to require the recipient to honor this Privacy Policy.
Service Providers and partners. Lexcel engages a number of service providers or partners to manage or support certain aspects of our business operations on our behalf. For instance, we currently use the following service providers who will handle your personal information:
- AWS – cloud data hosting
- GitHub – open source repositories and internal project management tool
- Slack – internal communications tool
- Stripe – payment processing
Our service providers and partners are required by contract to safeguard any personal information they receive from us and are prohibited from using the personal information for any purpose other than to perform the services as instructed by Lexcel.
Legal Requirements. We may disclose personal information to government authorities or other third-parties if required to do so by law or in the good faith belief that such action is necessary to: (a) comply with a subpoena, court order or similar legal obligation, (b) protect and defend our rights or property, (c) act in urgent circumstances to protect the personal safety of users of the Website or the public, (d) protect against legal liability, (e) to investigate fraud or other unlawful activity, or (f) or as otherwise required or permitted by law.
Lexcel takes measures reasonably necessary to protect your personal information against any unauthorized access, use, alteration, or destruction.
Transferring personal data to the U.S.
Lexcel has its headquarters in the United States. Information we collect about you will be processed in the United States. By using Lexcel’s services, you acknowledge that your personal information will be processed in the United States. The United States has not sought nor received a finding of “adequacy” from the European Union under Article 45 of the General Data Protection Regulation (“GDPR”). Pursuant to Article 46 of the GDPR, Lexcel is providing for appropriate safeguards by entering binding, standard data protection clauses, enforceable by data subjects in the EEA and the UK. These clauses have been enhanced based on the guidance of the European Data Protection Board and will be updated when the new draft model clauses are approved.
Depending on the circumstance, Lexcel also collects and transfers to the U.S. personal data with consent; to perform a contract with you; or to fulfill a compelling legitimate interest of Lexcel in a manner that does not outweigh your rights and freedoms. Lexcel endeavors to apply suitable safeguards to protect the privacy and security of your personal data and to use it only consistent with your relationship with Lexcel and the practices described in this Privacy Policy. Lexcel also enters into data processing agreements and model clauses with its vendors whenever feasible and appropriate
Data Subject rights
The GDPR and other countries’ privacy laws provide certain rights for data subjects. Data Subject rights under GDPR include the following:
- Right to be informed
- Right of access
- Right to rectification
- Right to erasure
- Right to restrict processing
- Right of data portability
- Right to object
- Rights related to automated decision making including profiling
This Privacy Policy is intended to provide you with information about what personal data Lexcel collects about you and how it is used. If you wish to confirm that Lexcel is processing your personal data, or to have access to the personal data Lexcel may have about you, please contact us.
You may also request information about: the purpose of the processing; the categories of personal data concerned; who else outside Lexcel might have received the data from Lexcel; what the source of the information was (if you didn’t provide it directly to Lexcel); and how long it will be stored. You have a right to correct (rectify) the record of your personal data maintained by Lexcel if it is inaccurate. You may request that Lexcel erase that data or cease processing it, subject to certain exceptions. You may also request that Lexcel cease using your data for direct marketing purposes. In many countries, you have a right to lodge a complaint with the appropriate data protection authority if you have concerns about how Lexcel processes your personal data. When technically feasible, Lexcel will—at your request—provide your personal data to you.
Reasonable access to your personal data will be provided. If access cannot be provided within a reasonable time frame, Lexcel will provide you with a date when the information will be provided. If access is denied, Lexcel will provide you with an explanation as to why access has been denied.
Alternatively, if you are located in the European Union, you can also have recourse to the European Data Protection Supervisor or with your nation’s data protection authority.
Data retention and deletion
Your personal data is stored by Lexcel on its servers, and on the servers of the cloud-based database management services Lexcel engages, located in the United States. Lexcel retains service data for the duration of the customer’s business relationship with Lexcel and for a period of time thereafter, to analyze the data for Lexcel’s own operations, and for historical and archiving purposes associated with Lexcel’s services. Lexcel retains prospect data until such time as it no longer has business value and is purged from Lexcel systems. All personal data that Lexcel controls may be deleted upon verified request from Data Subjects or their authorized agents. Privacy policy changes
Lexcel may change its privacy policy from time to time, and in Lexcel’s sole discretion.
If we make material changes to this Privacy Policy, we will notify you by updating the date of this Privacy Policy. Your continued use of this site after any change in this Privacy Policy will constitute your acceptance of such change.
